Long Awaited – FHA Approves e-Signatures

January 30th, 2014 No comments

It was announced today that the FHA will now accept e-Signatures. Industry pundits have said that the entire electronic real estate and mortgage transaction has been stalled to almost to a complete halt without this FHA buy-in. (E-Sign Act, June 2000)

Settleware has been advocating such advances and pioneering the effort since the late 90′s (and we have the arrows in the back to prove it)..this announcement will be well received by all Industry stakeholders, especially the consumer who has been needlessly inconvenienced, and will now open the path to e-Mortgage adoption.

NotaryCam Provides Strongest Digital Evidence-Period!

November 20th, 2013 No comments

According to a recent article by Austin Kilgore, American Banker “Court rules that dictate procedures for admitting evidence should be updated to reflect the nature of contemporary digital recordkeeping, a pair of federal judges said ….Until these rules and procedures for admitting evidence are updated to better address electronic documents, it’s critical for institutions like banks and mortgage lenders and servicers to keep this challenge in mind when developing the technology and processes used to generate and manage records that may later need to be admitted in court.”

There are an estimated 500 million real estate/mortgage related notarizations performed in the US each year (with more than 2 billion signatures). At the end of the day, this commerce represents the highest value/highest liability transaction that any consumer will partake in and, we now know, that Industry fraud has taken down the entire US economy and almost the entire World with it. Robo signing must be halted immediately – NotaryCam’s patented digital signature and recordable online e-Notary/Closing solution provides the strongest authentication, safe guards and digital evidence available today and for the foreseeable future.

E-signatures and e-notaries: How far will new technology go?

A notary’s job is to ensure an individual signing documents appears in person, is properly identified and acknowledges his signature in front of a trusted and impartial witness. The notary is the eyes and ears making sure the signer intends to sign, is competent to sign and is not being forced to sign the document. Technology and legislation, such as the Uniform Electronic Transaction Act (UETA), allow notaries and the signers to conduct the entire transaction electronically. but is that the best way?

Ticker Tape Newsletter _Summer 2013

September 20th, 2013 No comments

Hope everyone is ‘back to normal’ after what  seemed to be the ‘Endless Summer ‘ (I saw the movie 32 times – ok, so I was a movie usher..)

We kicked off our summer with a visit to Virginia Beach and introduced Notary Cam at the VA Land Title Association –  right smack in the middle of a tropical storm..Next stop, Alaska. What started out as a simple acceptance to present at the National Association of Secretaries of State Annual convention in Anchorage turned into an off-the-grid adventure well into the depths of Denali State Park-the short of it,  it’s easy to get lost within 6,000,000 acres! And for all you Yankee/Boston fans, the mosquito’s chanted “who’s your daddy? all week long! Yes, Deet became my new best friend. The good news is that, after knowing full well that I was heading into the lion’s den, our virtual and online remote notary/witness service, NotaryCam, received a surprisingly warm reception. Great bunch of folks that really care about the trust, security and valuable services offered by the professional notary.

As I look back I wonder whatever happened to the lazy days of Summer? We had an extremely busy one so I needed to come out of the ‘woods’ much sooner than I would have preferred. The team back on the mainland did a fabulous job of keeping the wheels greased ..and we welcomed many new e-Sign clients to the team: Prudential St Louis (600 agents), Simple Choice RE, St Louis Association, St Charles, County, Columbus Realtors, Athens (GA) Assoc, Mobile(AL) Assoc, Georgia RE Assoc, Greater Black Hills Assoc of the Dakotas, Southeast Alaska, Northern VA Assoc, CA Apartment Assoc , SF Apartment Assoc., many local Pillar To Post home inspectors across No America, US Global Mail and Hallmark Escrow (one the largest in CA).

We also went live with NotaryCam. (In beta for nearly a year and after nearly a decade after processing our first electronic notarization) Experiencing double digit monthly growth, the stories of how we helped so many are priceless: TOMI Entertainment Magazine interview

  • Charles Schwab client traveling in Germany notarized trust agreement
  • Busy Los Angeles doctor and his also busy CEO wife applaud the NotaryCam convenience
  • Businessman from Washington needing a notarization while traveling in Thailand-closest notary 3 hour train ride away (each way)
  • Minnesota Law firm needed to file affidavit in court less than 24 hours – client in China
  • Soldier in Iraq at risk of losing refinance rate and loan executes power of attorney
  • Hundreds of US  citizens sought out NotaryCam after hours/weekends
  • Chinese government accepts NotaryCam from Indiana couple – 21 days earliest appt at Embassy
  • NotaryCam professional notary prevents fraudulent activity by Florida couple traveling in Russia.

Enjoy your ‘back to school’ mindset and happy year end-only 100 days left!

NJ Allows Electronic Signatures for All Real Estate Contracts and Agreements

September 5th, 2013 No comments

On August 9, 2013 the NJ Legislation approved A3818 that offers clarification to the NJ UETA laws that allows for electronic signatures on all real estate transactions. We applaud and support this legislative effort which now enables real estate professionals and consumers the ease to legally e-Sign and execute documents over the Internet, anytime and from anywhere.

Opening and closing deals digitally has been the focus of Settleware for more than a decade and excited that this amendment now streamlines the entire real estate process and will eliminate most, if not all, of the inherent stress that buyers/sellers endure while processing the largest transaction they are mostly likely ever to make in their lifetime.
